Providing consent to withdraw your child from a council school

If your child already attends a public school, you must gain our consent before you can withdraw your child from school to home educate.

We cannot unreasonably withhold consent, but we require to be satisfied that a pupil’s educational needs can be met at home and that withdrawal from school will be in their best interests. 

If consent is granted, but we have subsequent concerns about the home education you are providing, we can take steps to consider whether we recommence school education.

Consent for withdrawal from the school roll is not needed if the child or young person:

  • has never attended a public school
  • has never attended a public school in the council’s area
  • is being withdrawn from an independent school
  • has finished primary education in one school but has not started secondary education in another
  • school has been attending has closed

You may wish to meet with a representative from Supporting Learners, or any other organisation of your choice, to discuss your proposals or provisions.

Where age-and capacity-appropriate, we will require to obtain and consider the views of your child or young person before deciding whether to grant consent.

You will also be given the opportunity to address, within a reasonable period, any specific concerns that we have relating to your request, before making our decision.
